Footnote 5 of the revised IBA Guidelines on the Conflicts of Interest in International Arbitration assumes that CAS arbitrators need no longer to disclose multiple appointments such as required under article 3.1.3 of said guidelines. The authors believe this is wrong, particularly in view of the new transparency policy of the ICC.
