Contrary to its previous leading cases regarding the independence of the CAS (Gundel, Latsutina and Pechstein) the question here under review was whether the CAS is independent despite receiving financial contributions by the IOC. After an in-depth analysis the Swiss Federal Supreme Court, however, confirmed the independence of the CAS.
