The Swiss Federal Supreme Court confirmed the independence of the CAS in a leading case published last Thursday
In its recent decision, which will be published in the collection of leading cases, the Swiss Federal Supreme Court dealt in detail with the question whether or not the CAS (Court of Arbitration for Sport) is independent. Contrary to its previous leading cases regarding the independence of the CAS (Gundel, Latsutina and Pechstein) the question here under review was whether the CAS is independent despite receiving financial contributions by the IOC. After an in-depth analysis the Swiss Federal Supreme Court, however, confirmed the independence of the CAS.
