Our newsletter comments on a recent decision of the Federal Supreme Court, to be added to its publication of leading cases, which clarifies that decisions on the jurisdiction of arbitral tribunals can be challenged only once the arbitral tribunal has made a final decision on its jurisdiction. In the present case the challenge was qualified as premature and the Court did therefore declare it as inadmissible.
